Article 1 – Definitions and applicability 1.1 In these general terms and conditions (“Terms”): “Hostel” means Hostel Strowis, located at Boothstraat 8, Utrecht, the Netherlands; “Guest” means any person who books accommodation with the Hostel or stays at the Hostel; “Hostel Agreement” means the agreement between the Hostel and the Guest for the provision of accommodation and/or related services. 1.2 These Terms apply to all offers, bookings, confirmations and Hostel Agreements, regardless of the booking channel (website, e-mail, in person or third-party platforms). They are inspired by the Uniform Conditions for the Hotel and Catering Industry (Uniforme Voorwaarden Horeca). 1.3 The house rules of the Hostel, as displayed at reception and published on the website, form an integral part of every Hostel Agreement. The Hostel may amend the house rules at any time; the amended rules apply from the moment they are made known at reception or on the website. 1.4 Deviations from these Terms are valid only if expressly agreed in writing and signed or confirmed by e-mail by the general manager of the Hostel. Any deviation applies solely to the specific booking for which it was granted and creates no rights for future bookings. Article 2 – Bookings and formation of the agreement 2.1 A Hostel Agreement is formed only when the Hostel has confirmed the booking in writing (including by e-mail or booking-platform confirmation). 2.2 The Hostel reserves the right of admission. It may refuse a booking or refuse to enter into a Hostel Agreement without stating reasons, insofar as permitted by law. 2.3 The Hostel may cancel a confirmed booking, against refund of any amounts already paid for the cancelled nights, if the booking (i) exceeds the maximum length of stay set out in Article 5, (ii) resulted from an obvious error or system failure, including a manifestly incorrect rate, or (iii) was made using false or incomplete Guest details. 2.4 Bookings are personal and non-transferable. Only the person(s) named in the booking may occupy the bed(s) booked. Article 3 – Rates and payment 3.1 The rates applicable are those published at the time of booking. Unless stated otherwise, rates include VAT; tourist tax (toeristenbelasting) is charged additionally where applicable. 3.2 Unless the booking has been prepaid, payment of the full price of the stay is due at check-in. For stays longer than seven (7) nights the Hostel may require payment per week in advance. 3.3 The Hostel is entitled at any time to require full or interim prepayment or an appropriate deposit. 3.4 If the Guest fails to make any payment when due, the Hostel may refuse or discontinue the accommodation and terminate the Hostel Agreement with immediate effect, without prejudice to the Guest’s obligation to pay for nights already enjoyed and any amounts due under the applicable rate conditions. Article 4 – Cancellation and no-show 4.1 Non-refundable rates: bookings made under a non-refundable rate cannot be cancelled free of charge. The full booking amount remains due, regardless of use. 4.2 Flexible rates: bookings made under a flexible rate may be cancelled free of charge until 12:00 (noon, CET) two (2) days before the arrival date; thereafter the full booking amount is due. 4.3 In the event of a no-show, the amount due is determined by the rate conditions applicable to the booking. 4.4 Termination of the Hostel Agreement by the Hostel pursuant to Article 5 or Article 7 does not constitute a cancellation by the Guest, nor a cancellation by the Hostel within the meaning of this Article. Article 5 – Maximum length of stay; no residential use 5.1 The Hostel provides short-stay tourist accommodation only. The maximum length of stay is fourteen (14) nights per period of three (3) months, calculated across all bookings and booking channels combined. The maximum applies per natural person, irrespective of the name, the spelling of the name, the e-mail address, the account or the booking channel used. 5.2 A longer stay is possible only with the prior written consent of the manager. Such consent is an exception, applies solely to the stay for which it is granted, may be made subject to conditions, and creates no right to any extension or future exception. 5.3 The Hostel may cancel, against refund of any amounts paid for the nights concerned, any booked nights exceeding the maximum set out in Article 5.1, including where such a booking was accepted by error or through an automated system. 5.4 The Hostel Agreement is a hospitality agreement (hotelovereenkomst) and expressly not a lease of living accommodation. The Guest cannot derive any tenancy rights or rent protection (huurbescherming) from the Hostel Agreement or from the duration of any stay. The Guest is not permitted to use the Hostel as his or her place of residence or to register the Hostel address as a home address in the Personal Records Database (BRP) without the Hostel’s written consent. 5.5 The Guest may not circumvent or attempt to circumvent the maximum length of stay, including by booking under a different, altered or false name, under the name of another person, or by having a third party book on the Guest’s behalf. Any such booking is deemed to have been made with false or incomplete Guest details (Articles 2.3 and 7.1(e)); the Hostel may cancel the nights concerned, against refund of amounts paid for unused nights, and may terminate the stay with immediate effect. For the application of this Article, the identity shown in the identity document presented at check-in (Article 8.2) is decisive. Article 6 – House rules and conduct 6.1 The Guest must comply with the house rules and with reasonable instructions given by Hostel staff. 6.2 The Guest shall behave respectfully towards staff and other guests. Aggression, violence, threats, intimidation, discrimination, harassment or other undesirable behaviour towards staff or guests, in any form and through any medium, on or off the premises, will not be tolerated. 6.3 The use or possession of illegal drugs, and any illegal activity on the premises, is prohibited. 6.4 Dormitories, beds and lockers are assigned by the Hostel and may be reassigned for operational reasons. 6.5 The Hostel may at any time take the measures it reasonably considers necessary to safeguard the safety, wellbeing and privacy of staff and guests and the order, peace and normal operation of the Hostel. Article 7 – Termination and removal by the Hostel 7.1 The Hostel is entitled to terminate the Hostel Agreement and to end the Guest’s stay with immediate effect, without judicial intervention, if the Guest: (a) violates the house rules or fails to follow reasonable staff instructions; (b) behaves aggressively, threateningly or otherwise improperly towards staff or guests; (c) causes nuisance, danger or damage, or disrupts the order, peace or normal operation of the Hostel; (d) fails to pay any amount when due; (e) provided false or incomplete information at booking or check-in; (f) engages in unlawful conduct on the premises; or (g) otherwise behaves in such a manner that, in the reasonable opinion of the Hostel, continuation of the stay cannot reasonably be required of the Hostel. 7.2 Where reasonably possible, the Hostel will first give the Guest a warning; in serious cases immediate termination without warning is permitted. 7.3 Termination and its principal reason will, at the Guest’s request, be confirmed in writing (e-mail suffices). 7.4 Upon termination the Guest must settle all outstanding amounts, vacate the bed and empty the locker, and leave the premises by the time indicated by the Hostel. Nights already enjoyed remain payable. Prepaid amounts for unused nights will be refunded, less any amounts owed by the Guest for damage or costs. 7.5 In the event of termination under this Article or under Article 5, the Hostel is not obliged to provide, arrange or pay for alternative accommodation, nor to pay any compensation, without prejudice to mandatory statutory provisions. 7.6 The Hostel may deny a Guest whose stay has been terminated under this Article future access to the premises and refuse future bookings. Article 8 – Check-in, identification and registration 8.1 Check-in from 16:00 until 23:59; check-out no later than 11:00 on the day of departure. 8.2 At check-in each Guest must present a valid identity document. The Hostel keeps a night register in accordance with Dutch law and levies tourist tax where applicable. 8.3 The minimum age to stay at the Hostel is 18 years, unless accompanied by a parent or legal guardian. Article 9 – Belongings, lockers and lost property 9.1 The Guest stores belongings at the Hostel at his or her own risk. The Guest is advised to use the lockers provided and to insure valuables. 9.2 At check-out, or upon termination of the Hostel Agreement, the Guest must empty his or her locker and remove all belongings by the time indicated by the Hostel. 9.3 If belongings are left behind after departure or termination, the Hostel may open and empty the locker and clear the bed in the presence of two staff members, drawing up a brief inventory. Items will be stored for a maximum of one (1) month, after which the Hostel may dispose of or donate them. Storage and shipping costs may be charged to the Guest. Article 10 – Liability of the Hostel 10.1 The Hostel is not liable for loss, theft of or damage to the Guest’s property, except in the event of intent or gross negligence on the part of the Hostel. 10.2 Any liability of the Hostel is limited to the amount paid by the Guest for the stay concerned or, if higher, the amount paid out under the Hostel’s liability insurance in the case concerned. 10.3 The Hostel is not liable for failures caused by force majeure. Nothing in these Terms limits liability that cannot be limited under mandatory Dutch law. Article 11 – Liability of the Guest 11.1 The Guest is liable for all damage to the Hostel, its inventory or third parties caused by the Guest or by persons for whom the Guest is responsible. 11.2 Where a booking covers several persons, they are jointly and severally liable for all obligations arising from the Hostel Agreement. Article 12 – Privacy 12.1 The Hostel processes personal data in accordance with the General Data Protection Regulation (GDPR/AVG) and its privacy statement, available at reception and on the website. Article 13 – Complaints 13.1 Complaints should first be reported to reception or the duty manager so that they can be resolved on the spot. Complaints that are not resolved may be submitted in writing to the management within four (4) weeks after departure. The Hostel will respond within four (4) weeks of receipt. Article 14 – Governing law, language and disputes 14.1 All Hostel Agreements and these Terms are governed exclusively by Dutch law. 14.2 Disputes will be submitted to the competent court of the District Court of Midden-Nederland (Central Netherlands), location Utrecht, unless mandatory law provides otherwise. 14.3 These Terms are drawn up in Dutch and English. In the event of any discrepancy, the Dutch version prevails. Article 15 – Final provisions 15.1 The Hostel may amend these Terms. The version in force at the time of booking applies to that booking. 15.2 If any provision of these Terms is invalid, the remaining provisions remain in full force and the invalid provision will be replaced by a valid provision that most closely reflects its intent.Los huéspedes deberán mostrar un documento de identidad válido y una tarjeta de crédito al realizar el registro de entrada.
